TERMS AND CONDITIONS and PRIVACY POLICY
This Privacy Policy describes how we, A La Carte Media Inc, DBA "BuyBack Booth", a Canadian corporation having its main office at 2327 Guenette, Montreal, Quebec, Canada H4E 2E9 may collect, use, dispose and share personal information gathered when visiting our websites, using our mobile applications, using our BuyBack Booth kiosks, or otherwise doing business with us ("using our Services"). We provide services in the field of electronic diagnostics of smartphones and other devices the results of which are then used to assist our partners in industries such as extended device warranty, device trade-in, reverse logistics, etc. ("Services").
INFORMATION WE COLLECT
There are three types of information that we may gather in the course of interacting with a user:
1. Device Information: If you are using one of our device-diagnosing assets, it may be necessary to collect certain device information such as the brand, model, unique identifier, storage capacity, results of functional testing of all of the device’s features, and attributes, device operating system, images of the device, etc. ("Device Information").
2. Personal Information: If you are using one of our device-diagnosing assets, it may be necessary to collect certain personal information such as your picture, image of a document authenticating your ID, and your signature. At certain times we may also capture your answers to questions like your name, billing address, shipping address, phone number, email, etc. ("Personal Information")
3. Transaction Information: In order to complete any transaction that uses any of our device-diagnosing assets, as well as any Device Information and Personal Information we may have collected, it may also be necessary to collect information relevant to a transaction such as location, date and time, unique transaction number, details of the transaction process, and the results of all of the testing done using one or more of all of our device-diagnosing assets ("Transaction Information").
We collect Transaction Information using the any of following technologies:
• "Cookies" (For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.)
• "Log files" that chronologically track events or actions occurring on our device-diagnosing assets.
• Electronic tracking technologies such as "pixels", "web beacons," or "tags".
• Data files transmitted including diagnostic results as a result of using or permitting the use of our mobile applications.
• Images or videos captured at the location of our device-diagnosing kiosk.
USE OF PERSONAL INFORMATION
All Transaction Information is strictly confidential information that we restrict access to with great care. This information is only used to complete or render any orders placed, or services rendered by using any of our Services. Additionally, we may use some Transaction Information.
• Communicate with you
• Validate trades or orders against potential risk or fraud.
• Collaborate with authorities, as needed by regulations or court orders, in order to reduce any risk of fraudulent use of our services, namely during electronic device trading
• Personal Information may be used to avoid certain risks and fraud and to ensure we are dealing with a legitimate person.
• We may also use Transaction Information to improve our services.
Restricted use of Personal Information
For clarity, we do not use Personal Information for any other reason than for validating your identity and ensuring the legitimacy of the transactions completed through the use of our services.
TRADE DEVICE DATA
We recommend and advise you to remove any and all data and information contained on any device tendered for trade through the use of our services. When trading a device, you will need to agree to be bound by the following Terms and Conditions of the trade:
• You acknowledge that this constitutes a full and final sale whereby you convey and transfer all of your rights and interests of sold item.
• You will confirm having removed any and all important or personal data from the sold item.
• You will no longer own any of the files, pictures, videos, or data whatsoever that may remain on sold item.
• You will no longer reclaim sold item nor its contents under any circumstances.
• BuyBack Booth is fully authorized to erase and destroy information remaining on sold item.
• Any attempt on your part to commit theft or fraud in connection to sold item will be disclosed to authorities and may result in fines and/or imprisonment.
• You understand that all Identity Information (such as my photo ID, signature, photos taken at Booth) will be held in strict confidence and will be remitted to authorities should this transaction be questioned. We will destroy copies of Identity Information when we deem the transaction complete and unquestionable.
• We use reasonable and responsible procedures to ensure that any data left on a trading device is removed by using leading-edge data wiping software when the device enters our processing facility or our selected partner’s processing facility. However, there can be no guarantee on our part or that of any of our partners that such data was not intercepted in one form or another and you bear all risks related to the use or misuse of such data left on the device. We strongly recommend you ensure all data is erased before trading any device.
DATA RETENTION AND LOCATION
If you use any of our services, we will maintain your Transaction Information for our records unless and until you ask us to delete this information. Your Personal Information is securely retained for the reasonable amount of time required by jurisdiction, laws, or regulations or as required to protect our rights against fraudulent use of our services and is destroyed afterward. Your Personal Information may be transferred or stored in servers located in Canada and the United States or Europe if you use our services in Europe.
MINORS
Trade of electronic devices requires a minimum age for consent that may vary by jurisdiction, and, as such, our services may not be made available accordingly. Even if allowed by law, we will not trade with any person under the age of 16 without clear parental consent.
CHANGES TO POLICY
We may update our privacy policy as deemed necessary to better reflect our continuously improving services, feature changes, legal or regulatory reasons.
